Terms of Service

These terms are between you and [LEGAL ENTITY NAME] ("Get The Photos", "we"), [MAILING ADDRESS]. By buying an event, claiming a code, or uploading to an event page, you agree to them. We wrote them in plain English on purpose.
1. What we sell
A hosted web page for one event (or one memorial), reachable by a QR code and a short link, where the people you invite can add photos, videos and written messages from a phone browser. You pay once per event (the three-event and Pro packs are several events bought at once; there are no subscriptions). There are no guest limits, upload limits, or extra charges for video.
2. Hosting term
Every album starts free: up to 100 photos of up to 25 MB each, no videos, with original-file ZIP downloads, kept for 12 months after the wedding date you give (or 12 months from creation if you have not given one). It needs only an email address, which we use for the sign-in link and reminders before the album closes. Upgrading lifts the photo limit and adds videos at once; it converts the same album in place, photos kept, and the 12-month term below runs from the wedding date you confirm. When the wedding is still ahead, you save a card and we charge it on the wedding date; if the charge fails we email you, keep the album open, and retry for a week before asking you to pay another way.
New wedding albums remain available for 12 months after the wedding date you select: through the first anniversary of that date, ending at midnight UTC immediately afterward. The exact deadline appears in your dashboard. Download and check your original files before that deadline. The album closes at expiry and files are removed from active storage by our cleanup process. Downloading does not delete files early or extend the deadline. Contact support if your wedding date changes.
Existing albums, previously issued claim codes, and purchases completed under earlier terms retain their original hosting commitment; this policy does not shorten them. You may delete an album earlier yourself. Reminder emails are a convenience; the displayed deadline applies even if a reminder does not arrive.
3. Originals
The file a guest uploads is the file we store. We make small preview copies for the web page, but we never replace or recompress the original, and the download always gives you the original bytes.
4. Your responsibilities as a host
- You confirm you are allowed to collect photos and videos at your event, and you are responsible for telling your guests.
- You are the "controller" of your guests' uploads in privacy law terms; we store and process them for you. If a guest asks you to remove their photo, you can do it from your dashboard.
- Keep the sign-in email address current. Access is by magic link to that address; whoever controls the address controls the album. You can add other people as admins; they can do everything you can, including removing you.
- When you email guests through the album, you confirm you may contact those people. We send one message per address with your note and the upload link, and keep a count for support.
- Deleting an album takes it offline immediately. For 30 days we can restore it if you ask; after that the photos are gone.
5. Your responsibilities as a guest
Only upload things you took or have the right to share. Don't upload anything illegal, sexual content involving anyone under 18, threats, harassment, or malware. We remove such content, may report it to law enforcement, and may block you.
6. Licences
Guests keep the copyright in what they upload. By uploading, a guest gives the host and us a licence to store, display, copy and let the host download the upload, for the purpose of running the event page. The host may use guest uploads privately; commercial use of a guest's photo is between the host and the guest.
7. Content removal
We may hide or remove content that breaks these terms or the law, and may close or delete an event used for abuse. Anyone can use the Report link on every page. Copyright complaints: see our DMCA page.
8. Child safety
We have zero tolerance for child sexual abuse material. If we become aware of such material we preserve it as required by law, remove it from public view, and report it to the National Center for Missing & Exploited Children (NCMEC) under 18 U.S.C. § 2258A. Report it to us at support@getthephotos.com or via the Report link.
9. Refunds
Full refund within 14 days of purchase if your event date has not yet passed, no questions asked — email support@getthephotos.com. Three-event and Pro packs are refunded pro rata for unused events in the same 14 days. After the event date we don't refund by default, but we will always help you get your files, and if something on our side broke your event we refund in part or in full. After a refund your event stays online for 30 days so you can download everything, then we delete it. Purchases made through Etsy follow the same rule; contact us and we refund through Etsy.
10. Fair use
Albums are for one event's photos and videos. We may limit uploads, downloads or storage that look like something else (a backup drive, bulk file sharing) and will contact you before closing an album for it.
11. What we don't promise
We run a small service carefully, with backups, but we cannot promise it is never down or that every upload from every phone will succeed. Our total liability to you is the amount you paid for the event. We are not liable for indirect losses. Nothing here limits liability that cannot be limited by law.
12. Accounts and security
There are no passwords; sign-in links are one-time and expire. Don't forward them. Tell us if you think someone has accessed your event without permission.
13. Changes and law
We may update these terms; material changes are announced by email to hosts. These terms are governed by the laws of the State of [STATE], USA. Disputes go to the courts of [COUNTY, STATE], unless the law where you live gives you other rights.
